In this free-of-charge module of the Websitecheck you as a company can answer some questions online and will receive an immediate general overview about the most important legal aspects of this theme under German law, e.g. imprint, consumer information, T&Cs, data protection, trademarks and copyright etc. This service is free-of-charge and will try to give a feasable clue on the most common pitfalls, however, cannot substitute an individual consultation. The exact requirements on the designing of an internet shop in many details do not arise directly from the written law but from the courts' case law which is developed on the regulations. However, the courts' judgements are rarely corresponding - in particular when a new legal problem on the Internet is affected. A behaviour, which is regarded as required or at least as permissable, is prosecuted by another court as impermissable violation. A clarification by the High Court quite often takes place only after several years. However, violations can be very expensive; e.g. when the imprint is incorrect or totally missing, a fine of up tu 50.000 EUR can be imposed, infringements of trademarks or unfair competition can result in written warnings from competitors represented by lawyers with legal costs of approx. 1.500 EUR and when copyrights are infringed (e.g. copying of photos or maps) despite the written warning and the licence costs for the past, in addition another licence payment for the future use can be due.
